Terms of Service

1. Who can use PAINT THAT

You must be at least 13 years old to use the Service. If you are under 18 (or the age of majority where you live), you may only use PAINT THAT with the permission and supervision of a parent or legal guardian, who agrees to these Terms on your behalf and is responsible for any purchases made through your account. We do not knowingly allow anyone under 13 to create an account or use the Service.

You can explore the studio as a guest, but an account is required to save work and place orders.

2. Your account

• Provide accurate details and keep your password secure
• You're responsible for activity that happens under your account
• Tell us immediately about any unauthorised access

3. Your prompts, photos, and artwork

You keep ownership of the prompts you write and the photos you upload, and — as between you and us — of the paintings generated from them. You may use your finished paintings personally or commercially.

You grant us a limited licence to store, process, display, and transmit your inputs and artwork purely to operate the Service: generating images, saving version history, showing your gallery, and sending approved files to our print partner. We do not use your prompts, photos, or artwork to train AI models.

You confirm you have the rights to everything you upload, including permission from anyone recognisable in a photo.

4. AI-generated results

Paintings are produced by AI models. Results vary, may not match your description exactly, and similar prompts can produce similar images for different users. AI output may not be eligible for copyright protection in some countries. Preview renders are lower fidelity than the final print-quality render, and on-screen color will differ slightly from ink on canvas or paper.

5. Acceptable use

Do not use PAINT THAT to create or order artwork that:

• Infringes copyright, trademark, or another person's likeness rights
• Is sexually explicit, or sexualises minors in any way
• Depicts real people in false, defamatory, or degrading situations
• Promotes hate, harassment, violence, or illegal activity
• Attempts to evade safety filters or reverse engineer the Service

We may refuse, cancel, or remove any generation or order that breaches these rules, and suspend repeat offenders.

6. Pricing and payment

Prices shown in the studio include printing, framing where selected, and the applicable shipping allowance, and update live as you change size, material, or framing. Taxes and duties may be added at checkout or on delivery. Payment is taken securely by Stripe at the moment you place your order; we never see or store your full card details.

7. Printing and delivery

Prints are produced on demand by our fulfilment partner in the facility closest to your address. Because every piece is made to order, we can only change or cancel an order before it enters production. Delivery estimates are estimates, not guarantees.

8. Refunds

If your print arrives damaged, defective, or materially different from the file you approved, contact us within 30 days with photos and we'll reprint or refund it. Because each item is custom-made to your own specification, we can't accept returns simply because you changed your mind about the design.

9. Availability

We aim to keep the studio running smoothly but don't guarantee uninterrupted service. Features, presets, materials, and models may change or be withdrawn. We are not liable for lost work caused by an outage, though version history is saved as you go.

10. Liability

The Service is provided "as is". To the maximum extent permitted by law, our total liability for any claim is limited to the amount you paid for the order the claim relates to. Nothing here limits rights you have under mandatory consumer law.

11. Data, advertising, and your consent

By creating an account and ticking the acknowledgement box, you agree to these Terms and to our Privacy Policy, which explains that we may share and, in some cases, sell certain personal information — identifiers, approximate location, browsing and purchase activity, and interest inferences — to advertising and analytics partners for interest-based advertising.

We do not sell or share your uploaded photos, your prompts, or the paintings you generate for advertising. You may opt out of the sale or sharing of your personal information at any time using the checkbox at sign-up, the checkbox shown when we update these documents, or the contact form. Opting out does not change your price or your access to the Service.

12. Changes and contact

We may update these Terms and our Privacy Policy. When a change is material, we will ask you to review and acknowledge the updated version the next time you sign in, and we keep a record of the version you accepted and the date you accepted it.
